GENERAL TERMS AND CONDITIONS OF USE OF GIVENCHY BEAUTY SOCIETY’S LOYALTY PROGRAMME

The present general conditions of use for the GIVENCHY BEAUTY SOCIETY loyalty programme constitute the fundamental principles governing access to and participation in the aforementioned programme.
1. PURPOSE
LVMH Fragrance Brands UK Limited is a company registered in England and Wales under company number 00939525 with its registered office being at 11-13 Old Esher Road, Hersham, Surrey, KT12 4NH. LVMH Fragrance Brands UK Limited has set up a loyalty program called Givenchy Beauty Society, (hereinafter referred to as "the Programme").
The purpose of these terms and conditions is to define the content and terms of use of the Programme, enforceable in the UK between LVMH Fragrance Brands UK Limited and any natural person that meets the Programme membership conditions (a “Member”). The Programme is valid in the following LVMH Fragrance Brands UK Limited points of sale: boutiques, locations within department stores and via authorised resellers but not in Givenchy boutiques located in airports (the “LVMH Fragrance Brands UK points of sale”) and as well as online at https://www.givenchybeauty.com/gb
The Programme is valid in the Givenchy Beauty points of sale specified below:

The Programme is not valid in Givenchy Beauty points of sale in airports.
2. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF USE
Registration and participation in the Programme are subject to the complete acceptance of and compliance with these general terms and conditions of use.
3. JOINING THE PROGRAMME
Membership of the Programme is free and without an obligation to purchase. It is strictly for personal use, allowing only one account per individual (defined by surname, first name, and email address).
The Programme is accessible to individuals aged 16 or over who have created a customer account on www.givenchybeauty.com/gb or in one of the aforementioned Givenchy Beauty points of sale.
Any eligible person who has created a customer account in a Givenchy Beauty point of sale or on www.givenchybeauty.com/gb is considered a member of the Programme. Registration is contingent upon the provision of complete and usable personal information by the member (the processing of the member's personal information is carried out under the conditions outlined in article 4 "Personal data"). Members are responsible for the accuracy of the information they provide. Givenchy Beauty reserves the right to request any document to prove the member's identity.
The Programme does not issue a physical loyalty card. Purchases at Givenchy Beauty points of sale and at www.givenchybeauty.com/gb are automatically included in the Programme. Members can find details of all information relating to the Programme on the dedicated GIVENCHY BEAUTY SOCIETY page ("The Programme" tab).
It is the member's responsibility to provide correct, complete, and up-to-date personal information on their account to benefit from all advantages. Givenchy Beauty may not be held responsible for the non-receipt of a benefit by the member if the information is not accurate, complete, or up-to-date.
4. OPERATION OF THE PROGRAMME
4.1. The Tiers
The Programme consists of four levels, known as tiers, with each member assigned to one of the four tiers based on the number of purchases made and the total amount spent in the last 12 months in the Maison's points of sale. Purchases considered are those made on separate days, meaning multiple purchases on the same day count as one.
Members can access different tiers as follows:
• "Pink" Tier: for Programme members who have not made a purchase. • "Silver" Tier: for members who have made one or more purchases for a total amount less than £200 in the last 12 months. • "Red" Tier: for members who have made one or more purchases for a total amount greater than or equal to £200 and less than £400 in the last 12 months. • "Black" Tier: for members who have made one or more purchases totalling £400 or more in the last 12 months.
Upon opening an account, members start in the "Pink" tier. Once achieved, a status and its benefits are valid for a period of 12 months. To reach a new status, the "total amount" criteria must be met.
At the end of the 12-month period, the member's status is recalculated. Members may renew their status if conditions are met or join a lower status if not.
Members may upgrade to a higher status at any time by meeting the "total amount" criteria for this higher status. In this case, a new 12-month period begins with their new status.
4.2. The Benefits of Each Tier
Each tier provides specific benefits, subject to change at the discretion of Givenchy Beauty.
• "Pink" Tier: Exclusive access to Private Sales. • "Silver" Tier: Exclusive access to Private Sales, Welcome Gift and Makeup Session in Store. • "Red" Tier: Exclusive access to Private Sales, Welcome Gift, Birthday Gift, Discovery Gift and Makeup Session in Store. • "Black" Tier: Exclusive access to Private Sales, Welcome Gift, Birthday Gift, Discovery Gift, Makeup Session in Store, Masterclasses, and a dedicated customer service line.
The benefits of each tier are independent, and it is not possible to accumulate benefits by moving from one status to another. Members will receive information by email concerning access to the gifts and benefits of their tier.

5. PERSONAL DATA
The information collected and processed within the framework of the Programme by the House is strictly reserved for the management of the customer account, registration in the Programme, for the purposes of running and managing the Programme (management of orders, sending of benefits linked to the Programme, provision of personalised services, communication of targeted offers), and, where applicable, by its technical partners within the framework of the management of the Programme.
In particular, in accordance with EU Regulation 2016/679 of 27 April 2016 on the protection of personal data (GDPR), you have the right to consult, modify and delete any data concerning you. You can read all of your rights by reading our Privacy Policy. Members accept that, where they choose to take part in any challenges, their personal data will be collected. Members can choose whether or not to take part in challenges which require Members to provide their personal data to LVMH Fragrance brands. 6. MODIFICATION / CANCELLATION OF THE PROGRAMME
Givenchy Beauty reserves the right to modify or suspend the Programme at any time and will inform the member by any appropriate means. In this case, the House does not guarantee that benefits not used by the member will remain accessible.
The House does not guarantee that a member who has not opened a Givenchy Beauty Society communication (email) or who has not visited the givenchybeauty.com/givenchybeautsociety website for more than 12 months will be informed of any changes to or cancellation of the Programme.
No modification or cancellation of the Programme will entitle the member to any form of compensation whatsoever.
As the Programme may evolve, Givenchy Beauty reserves the right to modify these General Terms and Conditions of Use. Members are, therefore, advised to refer regularly to the latest version of the General Terms and Conditions of Use of the Programme presented here.
In addition, if one or more stipulations of the General Terms and Conditions of Use are declared null and void by the application of a law, regulation, or following a final judicial decision issued by a competent court, the other stipulations will remain valid and applied.

8. TERMINATION OF PARTICIPATION IN THE PROGRAMME
8.1. At the member's initiative
Members may terminate their participation in the Programme at any time by giving notice of their decision:
• At Givenchy Beauty points of sale: on presentation of proof of identity
Termination of membership of the Programme will result in the firm and definitive withdrawal of the benefits acquired or associated with the member's account.
8.2. Fraudulent Use of the Programme, Suspension, or Deletion of the Account
The Programme assumes that the member complies with the rules and adopts loyal behaviour towards the House. In the event of non-compliance or abuse, the House reserves the right to temporarily suspend or permanently cancel the member's loyalty account and the associated benefits. In this case, the House will inform the member by any appropriate means. The member may not claim any compensation or indemnity, particularly in the following cases:
• In the event of fraud, attempted fraud, or theft by the member in the shop and/or on the www.givenchybeauty.com website. • In the event of inappropriate use or misappropriation of the Programme. • In the event of an abnormally high number of transactions on a single shopping day and/or over several days. • More generally, in the event of failure to comply with the provisions of these general terms and conditions of use.
9. LIABILITY
Givenchy Beauty does not guarantee that access to the Programme will be available without interruption. The House may not be held liable for this interruption or for the consequences of a malfunction of the Programme. In the event of a malfunction, the House will use its best efforts to restore access and ensure that the member can retain the benefits acquired.
10. INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights, whatever their nature, as well as all elements appearing on the Site and/or linked to the Programme (including, in particular: texts, logos, brands, graphics, images, photos, videos, animations, names, and any other element), are and remain the exclusive property of the House and are exclusively reserved to it. Under these conditions, no one is authorized to reproduce, represent, exploit, adapt, distribute, or use, by any process whatsoever, in whole or in part, the intellectual property rights without the prior written consent of the House.
11. APPLICABLE LAW - MODIFICATION – DISPUTES
These terms and conditions are subject to the laws of England and Wales and may be modified at any time by LVMH Fragrance Brands. Failing an amicable solution or mediation, any dispute resulting from the terms and conditions shall be submitted exclusively to the courts of England and Wales. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in either the Northern Irish or the English courts.
